Terms of Service
1. Agreement to these terms
These Terms of Service ("Terms") are a binding agreement between you and Stratos Explorations, LLC ("Flying," "we," "us," or "our") governing your use of the Flying iOS app, the flying.app website, and related services (together, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old (or the minimum age required in your country to use online services without parental consent) and legally capable of entering into this agreement to use the Service.
2. The Service
Flying helps you track flights, receive flight and airport status updates, keep a log of your past flights, view travel statistics, and share flights with friends. We may add, change, or remove features at any time as the Service evolves.
Important: Flight information in the Service comes from third-party data sources and may be incomplete, delayed, or inaccurate. The Service is provided for personal, informational purposes only. Always confirm flight times, gates, and other critical details with your airline or airport. Never rely on the Service for aviation, navigation, or other safety-critical purposes.
3. Your account
Some features require an account. You agree to provide accurate information when creating your account and to keep it up to date. You are responsible for all activity that occurs under your account and for keeping your credentials secure. Notify us promptly at [email protected] if you suspect unauthorized use of your account.
4. Purchases and subscriptions
Flying may offer optional paid features or subscriptions. All purchases are made through the Apple App Store and are subject to Apple's payment terms:
- Billing, renewals, and cancellations are handled by Apple through your Apple account. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period.
- You can manage or cancel subscriptions in your App Store account settings. Cancelling stops future renewals; it does not refund the current period.
- Refunds are handled exclusively by Apple under its policies; we are unable to issue refunds directly.
- If we offer a free trial, its terms will be presented at sign-up. Unused trial time is forfeited when you purchase a subscription.
5. Your content
You retain ownership of the content you add to the Service, such as your flights, notes, and photos ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content solely as needed to operate and improve the Service — for example, to sync your flights across your devices and show shared flights to friends you choose.
You are responsible for Your Content and must have the rights necessary to share it. Sharing is under your control: flights you share with friends are visible to those friends, and you can stop sharing or remove friends at any time in the app.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Copy, resell, sublicense, or redistribute the Service or its data, or use the Service to build a competing product or dataset;
- Access the Service by automated means (such as scraping, bots, or crawlers) or circumvent any access or rate limits;
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law;
- Interfere with or disrupt the Service, including placing excessive load on our infrastructure;
- Impersonate any person, misrepresent your affiliation, or harass or harm other users;
- Upload content that is unlawful, infringing, or malicious (including viruses or other harmful code).
7. License and intellectual property
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service. The Service — including its software, design, branding, and content other than Your Content — is owned by Stratos Explorations, LLC or its licensors and is protected by intellectual-property laws. No rights are granted to you other than the limited license described here.
If you believe content on the Service infringes your copyright, notify us at [email protected] with enough detail for us to investigate. We may remove content and may terminate accounts of repeat infringers.
8. Third-party services
The Service relies on and may link to third-party services, including flight-data providers and the Apple App Store. We are not responsible for third-party services, and your use of them may be subject to their own terms and privacy policies.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms, if we are required to by law, to protect the Service or its users, or if we discontinue the Service. Upon termination, your license to use the Service ends. Sections of these Terms that by their nature should survive termination (including Sections 10–13) will survive.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT FLIGHT INFORMATION OR OTHER DATA WILL BE ACCURATE, COMPLETE, OR TIMELY. YOU USE THE SERVICE AT YOUR OWN RISK.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STRATOS EXPLORATIONS, LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE — INCLUDING MISSED FLIGHTS, TRAVEL DISRUPTIONS, OR RELIANCE ON INFORMATION PROVIDED THROUGH THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR FIFTY U.S. DOLLARS (US$50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify and hold harmless Stratos Explorations, LLC and its officers, members, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. Either party may seek relief in small-claims court for qualifying disputes.
14. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app, by email, or by posting the updated Terms on this page before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. The "Last updated" date at the top shows when these Terms were most recently revised.
15. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
